What is vessel deletion or vessel withdrawal?

Removing a vessel from the ship register……done properly

Vessel deletion and vessel withdrawal are two names for the same thing: the formal removal of a ship or boat from a national ship register. The process results in a Certificate of Deletion, the official document confirming that the vessel no longer holds a registration under that flag state and is free to be registered elsewhere, scrapped, or closed out entirely.

Without that certificate, most ship registers worldwide will not accept a new registration application for the same vessel. It is the required proof that the previous registration has been properly and formally closed, not simply allowed to lapse, not lost in an incomplete application, but actually ended.

The process is not the same across all flag states. Every register has its own procedures, its own documentation requirements, and its own timescales. Some require the original Certificate of Registry to be surrendered. Others will not process a deletion until a registered maritime mortgage has been formally discharged. Some are responsive and straightforward; others are slow and require persistent follow-up.

Deletion, withdrawal, cancellation : the same process, different names

One of the first things that confuses owners and professionals alike is that different flag states use different language to describe the same legal act. Vessel deletion, vessel withdrawal, cancellation from the register, deregistration, all refer to the formal removal of a vessel from a ship register. The resulting document is variously called a Certificate of Deletion, a Certificate of Withdrawal, or a Letter of Deletion, depending on the authority issuing it.

The same variation applies when the vessel type is specified. Yacht deletion and yacht withdrawal refer to the same process applied to a pleasure craft. Work boat deletion and work boat withdrawal describe the same process applied to a commercial working vessel. The terminology follows the register and the vessel category, the underlying legal act is identical.

Common reasons for vessel deletion or withdrawal

The documents required – and whether an Apostille is needed – depend on both the flag state concerned and the reason for the deletion. We advise on what applies to your specific situation before anything is filed.

Re-flagging to a new register

The most common reason. The vessel is to be registered under a different flag state. The current registration, whether a yacht deletion or a work boat deletion, must be formally completed before the new registration can proceed.

Sale of the vessel

The vessel has been sold and the new owner will register it under a different flag. Vessel withdrawal under the previous ownership forms part of the transaction handover process.

Scrapping or decommissioning

The vessel is no longer fit for service or has been sent for recycling. Vessel deletion formally closes the vessel’s legal existence as a registered ship. No new registration follows.

Loss or sinking

Where a vessel has been lost or sunk, the register must be notified and the registration formally closed. Documentation requirements vary by flag state and by the circumstances of the loss.

Change of ownership structure

Some flag states require the owning entity to be incorporated in a specific country. Where the ownership structure changes and the vessel no longer meets the flag state’s eligibility criteria, a vessel withdrawal followed by re-registration may be the required route.

Delivery voyage requiring provisional registration

Where the vessel must be sailed to its new flag state, it must first be deleted so that a provisional registration can be issued for the transit. The deletion, provisional registration, and formal registration are managed as one coordinated sequence.

An important complication

Some registers require an Apostille on the Certificate of Deletion

Obtaining the Certificate of Deletion is not always the final step. A significant number of ship registers will not accept a Certificate of Deletion, whether from a yacht withdrawal or a work boat withdrawal, unless it has been legalised with an Apostille under the Hague Convention of 1961.

An Apostille authenticates the Certificate of Deletion so that it is officially recognised as a genuine public document in other countries that are party to the Convention. Where the receiving register requires one, arriving without it means the re-registration application will be refused, and the entire sequence must restart with the Apostille in place.

The Apostille is applied to the Certificate of Deletion after it has been issued. It cannot be obtained in advance. The correct sequence is: deletion first, then Apostille, then re-registration. Getting this wrong costs time that is often commercially significant, for a broker managing a transaction or an operator waiting to put a vessel back into service.
