The most common scenarios that require a formal deletion are re-flagging to a new register, a change of ownership where the buyer registers the vessel elsewhere, scrapping or decommissioning, and loss of the vessel. Scrapping or decommissioning

The vessel is being taken out of service or sent to the breakers. Deletion formally closes the vessel’s legal existence as a registered ship.

Loss or sinking

Where a vessel has been lost or sunk, the register must be notified and the registration formally closed. Documentation requirements vary by flag state and by the circumstances of the loss.

The two steps

Certificate of Deletion and Apostille legalisation

For many withdrawals, obtaining the Certificate of Deletion is the only step needed. But where the receiving register requires it, that Certificate must also carry an Apostille, and the two steps must be completed in the right order.

Step 01

Certificate of Deletion

The Certificate of Deletion – also referred to as a Certificate of Withdrawal or, in some registers, a Letter of Deletion – is the official document confirming the vessel has been formally removed from the register. It is issued by the flag state authority on completion of the deletion process.

Requirements vary significantly between registers. Some require the original Certificate of Registry to be surrendered. Others will not process a deletion until any registered maritime mortgage has been formally discharged, or until specific survey certificates have been submitted. We prepare the complete application for the relevant register and manage it through to issue.

Note: Where the vessel is being scrapped or has been lost, the Certificate of Deletion is the final document. No Apostille is needed, there is no receiving register that will need to accept it.

Step 02

Apostille Legalisation

An Apostille is a certification issued under the Hague Convention of 1961. It authenticates the Certificate of Deletion so that authorities in other member countries can rely on it as a genuine public document. Where a receiving register requires it, the Certificate of Deletion will not be accepted without one.

Not every register demands an Apostille, but enough do that it is a step worth confirming before the deletion application is submitted, particularly when the vessel is moving between registers in countries with different legal traditions. We check this for every case and advise before any work begins.

Important: The Apostille is applied to the Certificate of Deletion after it has been issued. It cannot be obtained in advance. Build this into the re-registration timeline from the outset.
